Is Marijuana Legal in Arkansas?
Recreational use of marijuana is not legal in Arkansas. However, there are statutory provisions that allow for its medicinal use in some cases.
As of 2023, medical marijuana is legal in Arkansas, but recreational marijuana remains illegal. The journey to legalize medical marijuana began back in 2006 when residents of Eureka Springs passed an initiative to make marijuana enforcement a low priority. Several other cities followed suit, but it wasn't until 2016 that medical marijuana was legalized at the state level through a ballot measure.
Under the current law, qualifying patients can use medical marijuana if they have a certification from a physician and a state-issued medical marijuana card. The conditions that qualify for medical marijuana treatment are specified by the Arkansas Department of Health.
Despite the legalization of medical marijuana, consumption of marijuana in public places is strictly prohibited. Additionally, the state has not legalized the recreational use of marijuana, and possession of the substance outside of the medical program is illegal and subject to penalties.
It's important for residents and visitors to be aware of these laws and understand that while medical marijuana is accessible for patients with qualifying conditions, recreational use is not permitted under the state's laws.
